2. Purpose and Scope

These Terms of Service govern access to and use of the MatGoat platform, a management software designed for Brazilian Jiu-Jitsu (BJJ), mixed martial arts (MMA), and other combat sports academies.

Using MatGoat implies full and unconditional acceptance of all conditions included in these Terms of Service. If you do not agree with any of these conditions, please do not use the platform.

3. Service Description

MatGoat offers the following main features:

• Attendance management: Attendance tracking system via tablet or mobile device.
• Student management: Student database with attendance history, belt promotions, and progress tracking.
• Private videos: Exclusive video content library for students.
• Communications: Messaging system to communicate with students.
• Payment management: Fee control and billing (available in Professional plan).
• Event calendar: Scheduling of classes, seminars, and special events.

4. Registration and User Account

To use MatGoat, you must create an account providing truthful and up-to-date information. The user agrees to:

• Provide accurate, current, and complete data during registration.
• Maintain the confidentiality of access credentials.
• Immediately notify any unauthorized use of the account.
• Not share the account with third parties.
• Update data when necessary to keep it accurate.

The user is responsible for all activities carried out from their account.

5. Plans and Pricing

MatGoat offers different subscription plans:

• Basic Plan: Includes essential features for managing academies with up to 50 students.
• Professional Plan: Includes all features, payment management, and unlimited students.

Prices and features of each plan are detailed on our pricing page. MatGoat reserves the right to modify prices with prior notice to users of at least 30 days.

6. Trial Period

MatGoat offers a 30-day free trial period. During this period, the user will have access to all platform features. At the end of the trial period, selecting a paid plan will be necessary to continue using the service.

7. Billing and Payments

Subscriptions are billed monthly or annually, according to the option chosen by the user. Payment is made in advance at the beginning of each billing period.

• Payments are processed securely through certified providers.
• Invoices are available in the admin panel.
• In case of non-payment, MatGoat may suspend access to the service.
• Prices do not include VAT, which will be applied according to current legislation.

8. Cancellation and Refunds

The user can cancel their subscription at any time from the control panel. Upon cancellation:

• Access will be maintained until the end of the current billing period.
• No additional charges will be made after cancellation.
• Data will be retained for 90 days after cancellation, allowing account reactivation.

MatGoat offers a 30-day money-back guarantee for new users. If you are not satisfied during the first 30 days, you can request a full refund by contacting hola@matgoat.com.

9. Acceptable Use Policy

The user agrees to use MatGoat responsibly and legally. The following is expressly prohibited:

• Using the platform for illegal or unauthorized purposes.
• Attempting to access systems or data without authorization.
• Distributing content that infringes third-party rights.
• Uploading illegal, offensive, or harmful content.
• Interfering with the normal operation of the platform.
• Using the platform to send unsolicited communications (spam).
• Reselling or redistributing the service without authorization.

10. Intellectual Property

All intellectual property rights over the MatGoat platform, including but not limited to software, design, logos, texts, and graphics, belong to Jose M Gilgado or its licensors. The user does not acquire any ownership rights over the platform through the use of the service.

Content uploaded by the user (videos, student data, etc.) remains the property of the user, who grants MatGoat a limited license to store, process, and display such content solely for the provision of the service.

11. Data Protection

MatGoat is committed to protecting users' personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish legislation. For more information on how we process personal data, please see our Privacy Policy.

12. Service Availability

MatGoat strives to keep the service available 24 hours a day, 7 days a week. However, we cannot guarantee uninterrupted service availability due to:

• Scheduled maintenance (notified in advance).
• System updates.
• Circumstances beyond our control (third-party failures, force majeure).

13. Limitation of Liability

MatGoat shall not be liable for indirect, incidental, special, or consequential damages resulting from the use or inability to use the service. In no event shall MatGoat's total liability exceed the amount paid by the user during the 12 months prior to the event giving rise to the claim.

14. Modifications to the Terms

MatGoat reserves the right to modify these Terms of Service at any time. Changes will be communicated to users by email or notification on the platform with at least 30 days' notice. Continued use of the service after the changes take effect implies acceptance of the new terms.

15. Applicable Law and Dispute Resolution

These Terms of Service are governed by Spanish law. For any dispute arising from these terms, the parties submit to the jurisdiction of the courts of the user's domicile, provided the user has consumer status. Otherwise, the courts of Madrid, Spain shall have jurisdiction.
